1. Definitions

"Company", "we", "us", or "our" refers to Atrb Services Limited, a company registered in the United Kingdom. "Client" or "you" refers to any individual or entity engaging the Company's services. "Services" means any website development, hosting, or related digital service provided by the Company.

2. Acceptance & Scope

Engagement of our Services constitutes binding acceptance of these Terms. The Company reserves the right to refuse, suspend, or terminate any engagement at its sole discretion, particularly where requests fall outside our published scope, ethics, or capacity. Any specific project shall additionally be governed by a separate written Service Agreement, which prevails over these Terms in the event of conflict.

3. Payment Terms

All projects require an initial deposit before work commences. Payment schedules are defined in the project Service Agreement. All bank, transfer, and currency conversion charges are the responsibility of the Client. Payments are deemed received only upon full cleared funds in our nominated account. Late payments may attract interest under the Late Payment of Commercial Debts (Interest) Act 1998 and may result in immediate suspension of all work, services, deliverables, and access without further notice. All paid amounts are non-refundable and represent compensation for time, effort, and resources committed.

4. Intellectual Property

All source code, designs, assets, and deliverables produced by the Company remain the sole and exclusive property of Atrb Services Limited until full payment has been received and cleared. Upon full settlement, ownership of bespoke deliverables transfers to the Client, subject to permanent reservations of pre-existing tools, libraries, frameworks, and methodologies which remain the Company's property. The Company retains a perpetual right to display non-confidential portfolio references.

5. Right to Refuse or Terminate

The Company reserves the absolute right to refuse, decline, or terminate any engagement at any time, with or without cause, including (without limitation) where the Client's conduct, communications, or requirements are deemed by the Company to be unreasonable, abusive, unethical, unlawful, contrary to the Company's values, or commercially impractical. Termination by the Company under this clause does not entitle the Client to any refund of paid sums.

6. Warranties & Limitation of Liability

The Company provides a bug-fix warranty of ninety (90) days from acceptance, covering reproducible defects in bespoke code. Except as expressly stated, all implied warranties are excluded to the fullest extent permitted by law. The Company's total aggregate liability shall not exceed the fees actually paid for the specific work giving rise to the claim. The Company shall under no circumstances be liable for indirect, consequential, or punitive damages.

7. Governing Law & Dispute Resolution

These Terms are governed by the laws of England and Wales. Unresolved disputes shall be referred to binding arbitration seated in Dubai, UAE, under the DIAC Rules, conducted in English by a sole arbitrator. The arbitral award shall be final and enforceable internationally under the New York Convention.

We collect contact information you provide (name, email, phone), project information you voluntarily share, limited technical information automatically collected by standard web technologies, and records of our communications with you. We collect only what is reasonably necessary.

2. How We Use It

To respond to enquiries, deliver our services, issue invoices and maintain accounting records, improve our work, and comply with UK legal, tax, and regulatory obligations. We do not sell, rent, or trade your information.

3. Retention

We retain data only as long as reasonably necessary or as required by UK law (typically six years for financial records). After this period, data is securely deleted or anonymised.

4. Your Rights

Under UK GDPR, you have the right to access, correct, request deletion (subject to legal retention), restrict, or object to processing of your data. Contact legal@atrb.uk. We aim to respond within thirty (30) days and reserve the right to verify your identity before fulfilling any request.

We implement reasonable technical and organisational measures to protect personal data. However, no transmission over the internet is completely secure, and absolute security cannot be guaranteed.

Our services are intended for lawful, ethical, and professional use. We welcome individuals, businesses, and organisations of all sizes seeking a legitimate, lasting online presence.

2. Strictly Prohibited Activities

The Company reserves the absolute and non-negotiable right to refuse, suspend, or terminate any engagement, without refund and without prior notice, where it determines, at its sole discretion, that the engagement involves or may involve any of the following:

• Content sexualising, exploiting, or endangering minors in any form.
• Terrorism, extremist propaganda, or incitement to violence.
• Trafficking of persons, weapons, or illegal substances.
• Fraud, deception, financial scams, or money laundering.
• Distribution of malware, ransomware, phishing, or malicious software.
• Harassment, hate speech, defamation, or targeted intimidation.
• Infringement of intellectual property rights, including piracy.
• Activities that violate the laws of the United Kingdom or any applicable law.

3. Sole Discretion

Determination of whether any activity falls within the prohibited categories rests solely and exclusively with the Company. Such determinations are final, are not subject to negotiation, and require no justification beyond the Company's own reasonable assessment.

4. Consequences

Where the Company identifies a violation, or reasonably suspects one, we may, without prior notice or liability, immediately suspend or terminate any work, withhold delivery of any product, source code, or credentials, retain all paid sums as compensation, cooperate with law enforcement, and pursue any remedies available under law.

2. Portfolio & Past Projects

Projects are categorised by authorship. Those marked as team-history were delivered by team members during prior professional engagements and do not constitute work shipped under Atrb Services Limited. Projects formally delivered by the Company are clearly labelled. All trademarks shown remain property of their respective owners.

3. No Guarantee of Results

While we are committed to delivering high-quality work, no specific outcome or performance metric is guaranteed unless explicitly stated in a signed Service Agreement. Past performance is not a guarantee of future results.

4. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any loss or damage arising from reliance on information presented on this website or from the use or inability to use this website.
